TERMS & CONDITIONS

THE SHORT VERSION

→Fit File Forge builds workouts and plans with AI and can send them to your Garmin account. AI can be wrong, and it isn't medical advice: check what it gives you, and train at your own risk.
→Free is free; the Pro trial needs no card and ends by itself; Pro renews until you cancel, and you keep it until the end of the period you paid for.
→Your workouts and data are yours. Use the service fairly, for your own training.
→If something goes wrong, our liability is limited (section 14). Washington law applies, and nothing here takes away the consumer rights you have where you live.

1) WHO WE ARE AND THESE TERMS

Fit File Forge is run by Forge Labs LLC, a Washington limited liability company (“we”, “us”). These Terms are an agreement between you and us about your use of the Fit File Forge website, app and services (the “service”). By creating an account or using the service you agree to them. Our Privacy Policy explains how we handle your data and is part of these Terms.

2) WHO CAN USE IT, AND YOUR ACCOUNT

→You must be at least 16 and able to agree to these Terms.
→Sign in with Google or create an account with an email and password. Give accurate details, keep your sign-in secure, and tell us if you think someone else has used your account. You're responsible for what happens under your account.
→An account is for one person. A Garmin Connect account is optional — you only need it to send workouts to your devices or to share your activities with us.

3) THE SERVICE

→You describe a workout and it is built for you, or you plan your training with your coach in one ongoing conversation. You can keep workouts in your Vault, schedule them, share them, and send them to Garmin.
→With Pro (or the Pro trial) you can also connect an AI app you use, such as ChatGPT or Claude, to read your training and to build, schedule and send workouts from that app (see section 8).
→We keep improving the service, so features will change, and some may be added, limited or removed. If we remove something you pay for, we'll tell you in advance where we reasonably can.
→We aim to keep the service available but can't promise it will always be uninterrupted or error-free, or that Garmin, OpenAI or other services we rely on will always work.

4) PLANS, THE PRO TRIAL AND BILLING

→Free. Free use with monthly limits on workouts and coach messages, shown on our Pricing page. No card required.
→Pro trial. Each account can have 14 days of Pro once, at no cost and without a card. The trial ends by itself and your account returns to Free; nothing is charged unless you choose to subscribe.
→Pro. Billed monthly or yearly, whichever you choose, at the price shown when you subscribe. Subscriptions to plans we no longer sell (such as Elite) include everything in Pro.
→Who takes your payment. Payments are processed by Lemon Squeezy LLC, a Stripe company, acting as our merchant of record and authorized billing agent (“Link”). By subscribing you agree to Link collecting payments on our behalf. Link sends receipts and invoices, handles sales tax, and helps with transaction issues. Charges appear on your statement as LINK.COM* FITFILEFORGE. We never see or store your card details.
→Renewal and cancelling. Subscriptions renew automatically at the end of each billing period until you cancel. Cancel any time in Settings; you keep Pro until the end of the period you've paid for.
→Refunds. We don't give prorated refunds for part of a billing period. Link may grant limited refunds within 60 days of a charge under its refund policy; for duplicate charges or billing errors, contact Link support. Where the law gives you a right to cancel and get a refund (for example within 14 days of buying in the EU or UK), that right applies. For anything else, email support@fitfileforge.com.
→Price changes. We may change prices with 30 days' notice. Existing subscribers keep their current price until the next renewal after the notice period, and can cancel before then.

5) FAIR USE

Unlimited plans are for one athlete's own training. Pro (and the Pro trial) has no monthly workout or coach-message limit on that basis. We may pause building and coach messages on an account whose use looks automated or shared — for example well over 100 workouts a month — while we review it, and we'll contact you first where we can. Your Vault and workouts already built stay available.

6) AI OUTPUT

Workouts, plans, answers, race predictions, summaries and web results are generated by AI models (from OpenAI; answers in an AI app you connect come from that app's models). AI can be wrong, incomplete or unsuitable for you — for example a target pace that is too hard, or a fact from the web that is out of date — and output isn't reviewed by a person before you see it. Use your own judgement and check anything important before you rely on it. Others may get similar output. Between you and us, you own the workouts and other output made for you, to the extent anyone can.

7) HEALTH AND SAFETY

→Not medical advice. Fit File Forge gives general training information. It is not a doctor, physiotherapist or coach who knows your health, and nothing it produces is medical advice, diagnosis or treatment.
→Talk to a medical professional before you start or change a training programme, especially if you have a health condition, an injury, are pregnant, or haven't trained for a while.
→Exercise carries risk of injury and, rarely, serious harm. You train at your own risk: stop and get help if you feel pain, dizziness, chest discomfort or anything unusual.
→You are responsible for checking that a workout's targets (heart rate, pace, power, distance) are safe for you, and for your surroundings while you train. Data from devices, including heart rate and estimated thresholds, can be inaccurate.

8) GARMIN AND OTHER SERVICES

→Garmin: we send the workouts you choose (and their schedule dates) to your Garmin Connect account through Garmin's Training API; once there, Garmin controls that copy. With “Tidy my watch” on (Settings → Garmin Connect; on unless you turn it off), we remove planned workouts we sent from your Garmin account 3 days after their date; they stay in your Vault.
→If you allow “Activities” on Garmin's consent screen, Garmin sends us the activities your devices record so we can show and analyse them for you and your coach can use them. You can change that permission in Garmin Connect at any time.
→Stopping sharing or disconnecting Garmin stops new activities arriving and keeps the ones you already have; they're deleted when you choose “Delete my activity data” in Settings or delete your account.
→AI apps you connect (your data, your direction). Your training data is yours. When you connect an AI app such as ChatGPT or Claude and agree to share, you instruct us to share your data with that app, limited to what you allow, for as long as it stays connected. Each app handles what it receives under its own terms and privacy policy, and your settings there; we don't control that and can't delete copies it already has. You can disconnect at any time in Settings → Connected Apps or in the app, which stops new sharing. Workouts are only sent to your watch when you ask, and the app asks you to confirm first. If you share output that includes Garmin data, keep its attribution.
→Garmin, OpenAI, Anthropic, Google, Link and the other services we use or you connect have their own terms and policies, which apply to your use of them. We aren't responsible for them, and if one changes or stops a feature, the matching part of our service may change or stop too.

9) YOUR CONTENT

→You own what you put in — your workout descriptions, messages, files, goals and profile — and the workouts made for you.
→You give us a limited licence to store, process, copy and display your content, and to send it to the providers that run the service (such as OpenAI and Garmin), only as needed to provide and improve the service for you. It ends when you delete the content or your account, except for the unlinked records described in our Privacy Policy.
→Only upload content you have the right to use. Don't upload other people's personal or health information without their permission.
→A workout you choose to share is public to anyone with its link, and others can save a copy. You can stop sharing at any time; copies already saved stay with the people who saved them.
→If you send us feedback or ideas, we may use them without owing you anything.

10) ACCEPTABLE USE

Don't use the service to:

→break the law, infringe anyone's rights, or harm or harass others;
→scrape, copy or resell the service, or use it to build a competing product;
→reverse engineer it, probe or test its security without our permission, or get around its limits;
→run automated or bulk use (an AI app you connect through Settings → Connected Apps, acting for you, is not bulk use), share an account, or create accounts to get extra free use or trials;
→upload malware, or anything illegal, hateful or sexually explicit.

11) OUR SERVICE AND NAME

The service, its software, design, the Workout Library and the Fit File Forge name belong to us or our licensors. We give you a personal, non-transferable right to use the service under these Terms; nothing else is licensed to you. Garmin, Garmin Connect and other trademarks belong to their owners.

12) ENDING YOUR USE

→You can stop using the service at any time, and delete your account in Settings → Data & Account. Deleting your account cancels any Pro subscription straight away; the rest of the paid period isn't refunded, except where the law requires it.
→We may suspend or close an account that breaks these Terms, puts the service or others at risk, or where the law requires it. Where we reasonably can, we'll tell you first and give you a chance to fix it or save your data. If we close your account without cause, we'll refund any unused prepaid period where the law requires it.
→Sections that by their nature should continue (such as health and safety, disclaimers, limitation of liability and disputes) continue after your use ends.

13) DISCLAIMERS

To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind, including accuracy, availability, fitness for a particular purpose or non-infringement. Training carries risk; see section 7.

Garmin services and data (including the Garmin Connect™ APIs and any workouts, activities or other data exchanged with Garmin) are provided to you through Fit File Forge “as is”, with all faults and without warranty of any kind. Garmin Ltd., its subsidiaries and its licensors (“Garmin”) disclaim all warranties and conditions, express, implied or statutory, including merchantability, satisfactory quality, fitness for a particular purpose, accuracy, timeliness and non-infringement, and do not warrant that those services will meet your requirements, operate without interruption, or be secure, accurate, complete or error-free. No information or advice from Garmin creates a warranty.

14) LIMITATION OF LIABILITY

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or exemplary damages, or for lost profits, revenue or data. Our total liability for all claims relating to the service is limited to the greater of (a) US$50 or (b) what you paid us for the service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits liability that the law doesn't allow to be limited, such as for death or personal injury caused by negligence, or for fraud.

To the fullest extent permitted by law, Garmin is not liable to you for any claim, loss, injury or damages, direct or indirect, arising from your use of Fit File Forge, the Garmin services or data it uses, or any act or omission of Garmin or any other party, including lost profits, lost or corrupted data, or incidental, special or consequential damages, even if Garmin was advised of their possibility. Garmin's total aggregate liability to you for any claim relating to Fit File Forge or the Garmin services it uses shall not exceed $1.00. Where the law does not allow a limitation, it applies to the maximum extent the law does allow.

15) INDEMNITY

To the extent the law allows, you agree to defend and indemnify Fit File Forge and Garmin against claims arising from your misuse of the service or your breach of these Terms.

Fit File Forge is not made, sponsored or endorsed by Garmin. Garmin is an intended third-party beneficiary of the disclaimers, limitations of liability and indemnity in Sections 13–15 and may enforce them directly.

16) GOVERNING LAW AND DISPUTES

→If you have a problem, please email support@fitfileforge.com first; most things can be sorted out quickly, and we'll try in good faith to resolve it within 30 days.
→These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules.
→Any dispute that isn't resolved will be decided only by the state or federal courts located in Washington State, and you and we agree to their jurisdiction. Either of us may instead bring an individual claim in a small-claims court that has jurisdiction.
→Nothing in these Terms limits rights you have under the consumer law where you live, including any right to cancel and get a refund. If you live in the EU, the UK or another country whose law gives you the right, you may also bring a claim in the courts where you live.

17) CHANGES TO THESE TERMS

We may update these Terms as the service or the law changes. We'll post the new version here with its date and, for changes that matter, tell you by email or in the app at least 14 days before they take effect. If you don't agree, you can cancel and stop using the service before then; if you keep using it after that, the new Terms apply.

18) GENERAL

These Terms and the Privacy Policy are the whole agreement between you and us about the service. If a part of them can't be enforced, the rest still applies. If we don't enforce a right straight away, we haven't given it up. You may not transfer your account or these Terms; we may transfer them as part of a merger or sale of the business, and we'll tell you if we do. We aren't responsible for delays or failures caused by events outside our reasonable control.
